谢谢!我也倾向于认为blameworthy需要control 而且如果没有当下的control,那就需要回溯的control,而且我倾向于认为Sher的这个例子里的士兵有回溯的control,所以士兵not blameworthy。
(不过澄清一下 我倾向于认为士兵not blameworthy only in the backward sense, 也就是说not blameworhty仅仅因为士兵之前睡着了这一行为,但这没有承诺士兵绝对not blameworthy,我恰恰认为士兵blameworthy in the forward sense,也就是说blameworthy因为blame能够给士兵一个教训让ta下不为例)
surely that’s really interesting!我同意你所说的“仍然有一个genuine disagreement”,这是我最近读的Plunkett and Sundell (2013, 2015, 2019) 所讨论的metalinguistic genuine disagreement(跟conceptual engineering/conceptual ethics相关),他们也像你一样认为当两个人在literal层面进行verbal dispute的时候,同时其实在implicature层面还进行着关于how a conceptual should be used from a metalinguistic perspective。
不过,我们和Sher的disagreement到底是否关于how the concept of blameworthy should be used,还要看Sher具体怎么回应的(ta怎么回应的呢?)。但即便Sher真的这么认为,那我的问题依然是可以问的,也就是说我和Sher关于blameworthy应该在backward还是forward意义上使用这个disagreement,是不是在philosophical intuition的level上的?如果是,更进一步,除了pragmatic consideration以外还有什么能帮助decide分歧的哪边“更正确”?
再unpack一下,pragmatic consideration包括很多,instrumental/prodential, moral, legal… 反正是from a human perspective(与此对立的是factual consideration,例如一千年前有人直觉是太阳绕地球转,有人直觉是地球绕太阳转,这里的consideration并不是pragmatic,而是factual,需要去explore external reality)。所以说,我们的观点好像其实是compatible的,依照你说的基本权利,我会说男女平等作为一个moral consideration可以支持“女人有工作权利”这个直觉。(不过这样的话“男女平等”这个直觉也就需要另外的moral consideration来支持,至于是否存在循环可能以及解决方案,另当别论)
最后,补充一下背景,我在问关于blameworthy的disagreement是不是amount to conflict intuitions,其实是服务于我paper,是在meta level上讨论the nature of blameworthy as an evaluative concept,如果有兴趣可私hh
我倾向于认为这种基于结果论的判断并不属于blameworthy。否则一个完全没有犯错的人也可能是blameworthy的了(仅仅因为blame可以带来更好的结果)。而一个voluntarily do wrong的人也可能是不blameworthy的(仅仅因为不blame可以带来更好的结果)。这显然是反直觉的。
所以我认为blameworthy不等于should be blamed。blameworthyness判断的是某个行为本身,而whether we should blame sb. for sth.则是一个all things considered道德判断。
至于这种规定是否成立这个质疑,我并不想为之justify,我只是认为有一群人(像我)会在直觉上倾向这种规定。就如这篇帖子的标题一样,我其实只是在收集conflict intuitions(服务于我meta discussion of blameworthiness)。但如果非要谈justification的话(并且假设你不同意这个规定),那么我会解释说,我们的disagreement其实amounts to conflict intuitions about how the concept of blameworthy should be used(也就是构成了一个conceptual negotiation,或者Plunkett and Sundell 2013所说的metalinguistic negotiation),然后我会说the considerations that tell for which side should be adopted are pragmatic considerations,in particular,在这个case里是moral consideration,即这个规定应该被adopted是是因为(morally speaking)这样对wrongdoer更公平。

关于blameworthy不等于should be blamed这一点,我想了一下觉得还是能认同的。
关于基于结果论的判断不属于blameworthy这一点,我可能不能完全认同。从pluralism角度上来思考blameworthy这个concept,我似乎倾向于认为可以有不同的legitimate的用法。也就是说,结果论的blameworthy的implication虽然反你的直觉,但可能不反某些人的直觉。不过这只是可能,这显然是一个实验哲学问题,这也是为什么我po这个帖子来收集intuition哈哈
